Leelanau County was just named the healthiest County in Michigan based on health outcomes that include length of life, quality of life, and various health factors. The report was released by the Robert Wood Johnson Foundation and the University of Wisconsin. Grand Traverse County (Traverse City) is ranked #7.

Michigan House Bill 4753 Becomes Law

Prevents Tax Increase on Family Real Estate Transfers

House Bill 4753 sponsored by Rep. Peter Pattalia is a bill that became law on December 28, 2012. The law will affect the transfer of real estate between family members beginning on December 31, 2013. Previously in Michigan when residential real property is transferred to a new owner (including family members), the taxable value generally “uncaps” to the true market value of the property. Once you own residential real estate the taxable value cannot increase from one year to the next by more than 5% or the rate of inflation, whichever is less, until that real estate is transferred to a new owner. This recently passed law will significantly impact many families in Leelanau County and Grand Traverse County (Traverse City), especially those families who have had the same property for 20+ years. Previously, if you planned on leaving residential real estate to a family member, the property tax “uncap” might not allow them to afford the new “market value” property tax, resulting in them being forced to immediately sell the family home.

Here is the exact language in the bill (page 4 of 5):

(s) Beginning December 31, 2013, a transfer of residential real property if the transferee is related to the transferor by blood or affinity to the first degree and the use of the residential real property does not change following the transfer. As used in this subdivision, “residential real property” means real property classified as residential real property under section 34c.

(e) Residential real property includes the following:
(i) Platted or unplatted parcels, with or without buildings, and condominium apartments located within or outside a village or city, which are used for, or probably will be used for, residential purposes.
(ii) Parcels that are used for, or probably will be used for, recreational purposes, such as lake lots and hunting lands, located in an area used predominantly for recreational purposes.

The one concern that I am sure will be a hot topic is that this law doesn’t discuss the role of trusts in the transfer of real estate. It does however for the first time allow for the transfer of residential real property to children and step-children without the “uncapping” of property taxes.

Here is a fictional example of could happen starting December 31, 2013:

Suttons Bay waterfront vacation home that has been in the same family since 1972

Current Taxable Value = $200,000 (paying tax on a $400,000 true cash value)
Current Assessed Value = $300,000 ($600,000 true cash value)

-The current owners in this scenario pay non-homestead tax of = ~$7,820 per year.
-Property Transfers under old system “uncaps” the non-homestead tax to = ~$11,730 per year.

Under the new law (Michigan House Bill 4753) the family member(s) will save about $3,550 per year!

Many of waterfront homes on West Grand Traverse Bay, Suttons Bay, Lake Leelanau, Glen Lake, and Lake Michigan could see a $10,000-$20,000 per year difference especially if it is a large “estate” size waterfront parcel that has been in the same family for a long time!

2011 3rd Qtr YTD Leelanau County Home Sales Statistics
(January 1 - September 30)

I have calculated the updated 2011 3rd quarter year-to-date (January 1 - September 30th) recent home sales data and market sales trends for Leelanau County and have posted the information above. The home sales statistics compare real estate housing sold in Leelanau County from January 1, 2011 through September 30, 2011 to the same time period in 2010 and 2009. This includes the townships of Bingham, Centerville, Cleveland, Elmwood, Empire, Glen Arbor, Kasson, Leelanau, Leland, Solon, Suttons Bay, and the City of Traverse City within the southeast corner of Leelanau County.

As you will notice in the housing sales data posted above, 2011 residential real estate sold in Leelanau County has declined slightly compared to 2010 in terms of average selling price (- 3.5 %) and median sales price (-3.5%). We are seeing increases in residential sales volume (+ 7.7 %), and total houses sold (+ 11.5 %) compared to this time one year ago. Median sale price and average sale price has decreased in so far in 2011 mainly due to a large number of sales of entry level affordable homes within Leelanau County. I will post the entire 2011 sales statistics and market report in early January 2012 once the December home sales are finalized.

I have calculated the updated 2011 year-to-date (January 1 - September 30th) recent home sales data and market sales trends for the Traverse City area / Grand Traverse County and have posted the information above. The home sales statistics compare housing sold in Grand Traverse County (Traverse City area) from January 1, 2011 through September 30, 2011 to the same time period in 2010 and 2009. This includes the townships of Acme, Blair, East Bay, Fife Lake, Garfield, Grant, Green Lake, Long Lake, Mayfield, Paradise, Peninsula, Union, Whitewater, and the City of Traverse City.

As you will notice in the housing sales data posted above, 2011 residential real estate sold in Grand Traverse County / Traverse City has continued to remain almost identical to 2010 in terms of average selling price, median sale price, sales volume, and total units sold. Average selling price is up 3.2%, median price is identical, volume sold is identical, and residential units sold is down 3.2%.

2009 Lake Michigan Water Levels

There has been a continuous surge of good news this winter regarding Lake Michigan’s current water levels. The US Army Corps of Engineers February 2009 readings have indicated that Lake Michigan-Huron’s monthly mean water level was 577.46 feet, 10 inches higher than last year! Lake Michigan remains about 11 inches below its long term average but projected lake levels indicate that the gap is closing. I am sure that Grand Traverse area lakefront property owners and boaters are pleased to see the levels rising back towards normal levels.

Unfortunately the final few months of 2008 didn’t bring the economic stability of years past, but that doesn’t mean that my first blog entry can’t close 2008 with some good news for everyone.

Mortgage rates fall to 37-year low!

30 year-fixed mortgage rates fell to a national average of 5.19%. If you would like to read the corresponding article on CNN Money, you can find it by clicking here. Hopefully by the Fed slashing key interest rates to near zero, we will finally see an increase in mortgage applications which will ultimately help shorten this housing slump. We are quite blessed to be in Northern Michigan, not only for the natural beauty that we are all quite aware of, but also for shelter from the large decreases in property and home values the rest of the state is experiencing . We will be ok! Make sure to check back in January as I will post data on 2008 sales figures in our area compared to previous years. See you all in 2009!
